What should I know about making a personal injury claim?

To get compensation for an accident, injury or illness, this must be caused by the mistake, the negligence or 'fault' of someone else. You can still claim compensation even if you were partly to blame.

The fault may be clear, for example, when another driver crashes into your car. Some cases may be less obvious such as whether your employer provided appropriate safety equipment for your job.

Claims must be brought within strict time limits - usually 3 years from the date of the accident. For a child the claim must be brought by the time he or she is 21, although there are exceptions.

How much compensation will I get?

There are two parts to your compensation.

Part of the compensation covers your pain and suffering. This is assessed with the help of expert medical evidence. We arrange for a medical examination and a medical report, at no cost to you. There are guidelines used by the Court for the amounts of money recoverable in respect of particular injuries e.g. broken arm, whiplash injury, back injury. When we obtain the medical report we will usually provide you with an initial valuation of what sort of sum a court may award you based on that evidence.

The rest of your compensation relates to any financial losses and expenses - both past and future. These are assessed by the Court according to the evidence that we can gather to prove the amount you have lost. These losses may include medical expenses, loss of earnings, travel costs and the cost of any care and assistance you have had or may require in the future. Where appropriate we will instruct experts such as Accountants or Care and Rehabilitation Advisers to provide evidence and support about your losses.

You will receive 100% of your compensation recovered from your claim.
